Defamatory, Slander or forms of Harassment
Material that is defamatory, slander or forms of harassment against Metro Mouse Entertainment will be deemed a violation of this Agreement and may be subject to further liability.
Example of forms of publication but not limited to;
• Forum Topics or posts
• Social Media Content such as Twitter, Facebook
• Review or Feedback Websites
• Offensive Images or text
Metro Mouse Entertainment reserves the right to cancel bookings without warning if found to be in violation of this Agreement. Metro Mouse Entertainment will decide in its sole and absolute discretion what constitutes a violation of this agreement.
Cancellations/ Refunds
*Cancellations after the booking is made will incur a 50% fee of the total quoted amount.
*Cancellations 3 weeks or less before the event, will require a full payment of the total quoted amount.
*if your function is shut-down (before or during) for any reason (by police or another third-party) you will not be entitled to a refund. The quoted amount must be paid in full
Booking Changes
A 10% administration fee will be incurred for any changes to the date of your booking.
Payment
The price which the customer has been quoted is the price which must be paid no matter what occurs at the event. There is no hourly fee, if for some reason the event only goes for a portion of the time originally quoted for, the full fee must be paid.
Damages
If there are any damages to the equipment or personal belonging of any of our staff, the onus is on the host of the event (the person who submitted the enquiry/booking form).
Weather/uncontrollable event
If the weather is posing a serious threat to the equipment or safety of Metro Mouse Entertainment staff, we reserve the right to leave the event immediately.
Limitation of Liabilities
YOU AGREE THAT NEITHER METRO MOUSE ENTERTAINMENT SHALL BE LIABLE FOR ANY DAMAGE, LOSS, OR EXPENSE OF ANY KIND ARISING OUT OF OR RESULTING FROM YOUR USE OF THE SERVICES, MATERIALS, CONTENT, OR INFORMATION ON ITS SITES REGARDLESS OF WHETHER SUCH LIABILITY IS BASED IN TORT, CONTRACT, OR OTHERWISE. IN NO EVENT, INCLUDING WITHOUT LIMITATION A NEGLIGENT ACT, SHALL METRO MOUSE ENTERTAINMENT OR ANY OF ITS CONTRACT WORKERS BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, LOSS OR CORRUPTION OF DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR INTERRUPTION OF BUSINESS), ARISING OUT OF OR IN ANY WAY RELATED TO THE SERVICES, MATERIALS, CONTENT OR INFORMATION PROVIDED BY METRO MOUSE ENTERTAINMENT OR ANY OTHER PRODUCTS, SERVICES, OR INFORMATION OFFERED, SOLD, OR DISPLAYED ON METRO MOUSE ENTERTAINMENT’S SITES, YOUR USE OF, OR INABILITY TO USE METRO MOUSE ENTERTAINMENT’S SERVICES GENERALLY, OR OTHERWISE IN CONNECTION WITH THIS AGREEMENT, REGARDLESS OF WHETHER METRO MOUSE ENTERTAINMENT OR ANY OF ITS PROVIDERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES DO NOT ALLOW THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
Compliance with Law
You agree that when using the Services you shall comply with all applicable laws and regulations. You shall not use the services in any way that violates Australian export laws, including without limitation, uses related to the distribution of weapons of mass destruction, prohibited chemical or biological.
Minimum Age Requirement
Metro Mouse Entertainment customers must be at least 18 years of age. Any individual under the age of 18 years (“Minor”) must have a parent or guardian accept this Agreement for the Minor to become a Metro Mouse Entertainment customer. A parent or guardian who accepts this Agreement on behalf of a Minor will be primarily liable for ensuring complete and proper compliance with this Agreement, including the timely and full payment of the charges for Metro Mouse Entertainment services, and such primary liability will continue even when the Minor has attained the age of 18, unless the parent or guardian obtains Metro Mouse Entertainment’s express written consent to the contrary.
